Asset declarations in Brazil: who declares and whether it is public
Laws
- Lei n. 9.504/1997 (Lei das Eleições), art. 11, paragraph 1, IV (declaration of assets signed by the candidate) (1997)1
Who must declare
Candidates for elected office must attach a declaration of assets, signed by the candidate, to their application for candidate registration. This record covers the electoral candidate system run by the Superior Electoral Court (TSE). Asset declarations by serving public officials under separate legislation are not covered.1
What is declared
The candidate's assets, such as real estate, vehicles, stakes in companies and personal businesses, bank account balances, savings, shares and other investments. Under TSE case law, updated values and changes in assets need not be reported, and a candidate with no assets must declare that fact.2,1
How often
With each application for candidate registration, at every election in which the person stands.1
Public access
The TSE publishes each candidate's list of declared assets on its DivulgaCandContas portal, where users choose the region, the office and the candidate's name. TSE case law holds that the declaration is not covered by secrecy similar to banking or tax secrecy. In August 2022 the TSE Plenary decided that candidates' data must remain public despite the General Data Protection Law (LGPD).2,1

Who verifies
The Electoral Justice reviews candidate registration. TSE case law allows the truthfulness of a declaration to be examined after registration where there is concrete evidence of falsity.1
Sanctions in law
A registration application without the declaration can as a rule be refused. Under TSE case law, an incomplete declaration does not in itself constitute ideological falsity, and an omission without intent and without effect on the vote does not justify annulment of a mandate.1
Notable developments
- The TSE Plenary decided that candidates' data, including declared assets, must remain public despite the LGPD. TSE President Alexandre de Moraes said public administration has a duty of absolute transparency.2
