For the declaration chapter the term also covers certain heads of non-commercial legal entities and state-owned enterprises, some public servants, and entities listed by Government ordinance.1

What is declared

Property of the official and family members as of the first day of the month the declaration is completed, income and expenses for the preceding year, bank accounts and deposits the official or a family member can administer, and cash above GEL 10,000. Family members are the spouse, minor children, stepchildren and persons permanently living with the official.1

How often

Within two months after appointment, annually in the same month as the previous declaration, and within two months after dismissal (by 31 December of the dismissal year if the period runs into the next year).1

Public access

Declarations are published within two months after submission, after the State Audit Office checks them. Information in a declaration cannot be issued as public information until it is published. Declarations of certain candidates, such as parliamentary and judicial candidates, are published more quickly.1

Where to find declarations

State Audit Office of Georgia, which receives, verifies and publishes declarations under article 14 of the law.1

Who verifies

The State Audit Office handles submissions, verification and publication. If a defect is found it notifies the official within one month and allows up to one month to correct it.1

Sanctions in law

The law provides for a fine for failing to file and makes the official responsible under the law for late filing. Dismissal is required if a court confirms that the official owns illegal or unsubstantiated property.1
