What is declared

Assets and liabilities, with supporting evidence and proof of personal income tax paid in the previous tax year.1

How often

Political office holders under section 102(1), (2), (3) and (9) file on taking office and on leaving office. Officials under section 102(4) to (8) also file every three years while in office (section 105). For the Srettha Thavisin government the NACC said filings were due within 60 days, counted for the Prime Minister and ministers from the oath date and for MPs from their oath in Parliament, with an extension of up to 30 days if requested before the deadline.2,1

Public access

Section 106 requires the NACC to disclose the declarations of the Prime Minister, ministers, MPs and senators and of persons under section 102(2), (3), (7) and (9), with those of spouses and minor children, no later than 30 days after the filing deadline, leaving out ID details and personal data that could cause harm. Other declarations are not disclosed. In 2023 the NACC said 53 declarations could be viewed at the exhibit room on the first floor of its office from 15 September to 14 October 2023.2,1

Where to find declarations

Office of the National Anti-Corruption Commission (NACC). Declarations are filed in person, by registered mail or online through the ODS system at asset.nacc.go.th.1

Who verifies

National Anti-Corruption Commission (NACC). It checks the accuracy and existence of declared assets on first filing and changes in later filings, may order agencies and financial institutions to verify assets, and publicly discloses whether its examination found anything abnormal (sections 110 to 112). Unexplained wealth leads to an inquiry seeking forfeiture to the state (section 113).2

Sanctions in law

Late or incomplete filings first trigger notice and correction periods (section 109). Intentional non-filing, false information or concealment with apparent intent to hide the source of assets is referred by the NACC to the Supreme Court Criminal Division for Persons Holding Political Positions for political office holders, or to the Criminal Court for Corruption and Misconduct Cases for other officials (section 114).2
